Terms of Service

Version 2026-07-19. The Swedish version governs for customers established in Sweden; this English version governs otherwise.

1. Parties and scope

These terms apply between Atlas Holly ("we", "us") and the business creating an account ("the customer", "you"). The service is offered to businesses only - not to consumers. By creating an account you confirm that you represent a business and are authorised to enter into this agreement, and you also accept our Data Processing Agreement.

2. The service

Atlas Holly is a platform for building, publishing and running your company's website with related features such as bookings, price lists, statistics, campaigns and AI-assisted content. The feature set follows your chosen plan and may evolve over time. AI-generated content is a suggestion: you are responsible for reviewing and approving it before publication.

3. Account and security

You are responsible for the accuracy of your account details and for all activity under your account. Sign-in uses one-time links and codes sent to your email address; protect your email accordingly. Two-factor authentication is available and recommended.

4. Trial, fees and payment

• New accounts start with a free trial. No payment card is required during the trial, and it does not convert into a paid subscription until you choose a plan and add a payment method.
• Fees are as listed in the current price list. Your price is fixed in the currency that applied when the subscription started.
• Payment is made in advance, monthly or yearly. If a payment fails we retry on a schedule and remind you; if all retries fail the subscription is cancelled and the website is put to rest (hidden from visitors) until payment is made.
• We may adjust prices with at least 30 days' notice, effective from the next renewal.

5. Online payments from your customers

• With the online payments feature your customers pay bookings and purchases directly to you, through your own account with the payment provider Stripe. The money goes straight to you - we never receive or hold your funds. Your agreement with Stripe is entered into directly between you and Stripe and is governed by Stripe's terms.
• For each completed online payment we charge a platform fee of up to 2% of the transaction amount, in addition to Stripe's own transaction fees. The fee is deducted automatically at the time of payment. The fee that applies to your account is always shown in the service's payment settings.
• For security reasons a per-transaction amount limit applies. The limit is shown in the service and can be raised on review, via a request in the payment settings.
• Refunds and disputes (such as chargebacks) towards your customers are handled in your Stripe account and remain your responsibility.

6. Your content and responsibilities

You own your content. You warrant that it does not infringe third-party rights or violate law, and that you are entitled to use the images, texts and data you upload. You are responsible for the accuracy of prices, opening hours and offers towards your own customers, and for your own compliance with consumer and marketing law.

7. Acceptable use

The service may not be used for unlawful content, spam, intrusion attempts, malicious code, or to circumvent the service's safeguards. We may suspend accounts in breach, with prior warning where reasonable.

8. Intellectual property

The platform, its code, themes and trademarks belong to us. You receive a non-exclusive right to use the service for the duration of the agreement. Your content remains yours; you grant us the technical licence needed to store, process and display it as part of the service.

9. Personal data

For personal data where you are the controller (for example your customers' bookings) we act as processor under the Data Processing Agreement. For data about you as our customer we are the controller, as described in our Privacy Policy.

10. Availability and support

We aim for high availability but do not guarantee uninterrupted operation. Planned maintenance is scheduled outside peak hours where possible. Backups are taken daily and verified automatically. Support is provided through the in-service support function.

11. Limitation of liability

The service is provided as is. We are not liable for indirect damages such as lost profit or goodwill. Our aggregate liability per twelve-month period is limited to the fees you paid for the service during that period. These limitations do not apply in cases of intent or gross negligence.

12. Term, termination and deletion

• You may cancel the subscription at any time effective at the end of the current period; paid periods are not refunded.
• You may export your data and delete your account in the service at any time. On deletion everything personal is removed; invoice records are archived in de-identified form for seven years as required by the Swedish Bookkeeping Act.
• We may terminate for material breach, or if the service is discontinued - in the latter case with at least 90 days' notice and the opportunity to export your data.

13. Changes to these terms

We may amend these terms with at least 30 days' notice by email or in the service. Continued use after the change takes effect constitutes acceptance. The version line above identifies the current revision.

14. Governing law and disputes

Swedish law applies. Disputes are settled by the Swedish general courts, with the Stockholm District Court as first instance.
